Products once sold will not be taken back. The complaint in respect of Products supplied vide this invoice must be reported in writing within 15 days from the Invoice date. HCL retains the right to reject such cases, which it does not deem fit without assigning any reason. HCL shall at its option, either repair or replace products, which are proved to be defective. In cases where HCL requires the defective parts to be returned, replacement parts will be supplied only after the defective parts are received back by HCL.

Warranties
The limited warranties applicable to HCL-branded products are included in the documentation along with the products.
Any express warranties will be effective only upon HCL's receipt of payment in full for Customer's total order value.
HCL makes no express warranties except those stated in this section and in HCL's applicable warranty statement in effect on the date of invoice. HCL disclaims all other warranties, express or implied, including without limitation implied warranties of merchantability and fitness for a particular purpose, and without warranty as to non-infringement or the performance or results you may obtain by using the content.
HCL's responsibility for warranty claims is limited to repair and replacement as set forth in HCL's applicable warranty statement. HCL reserves the right to modify terms of its warranty at any time, in its sole discretion. All software is provided subject to the licence agreement that is part of the package. Customer agrees to be bound by the licence agreement once the package is opened or its seal is broken or the software is installed. HCL does not extend warranty in respect of any software. Warranties, if any, for the software are contained in the licence agreement that governs its purchase and use. All other products are covered by the original manufacturer's limited warranty. Warranties, if any, do not cover damage from everyday wear and tear, abuse or from transportation by a common carrier

The Shipment of any products ordered is subject to HCL's availability schedule. HCL shall make every reasonable effort to meet any delivery date(s) quoted or acknowledged. However, HCL will not be liable for its failure to meet such delivery date(s)

2.The delivery slip showing acceptance of the package by courier will be proof of
acceptance of the products ordered by you.
3.Title in goods passes upon shipment and risk of loss passes upon delivery by our
carriers.
4.All shipments within INDIA are insured at no additional charges. Where the insurance
is arranged by HCL, any claims for short shipment / loss / damage, if it is not
apparent at the time of delivery must be made by the customer to HCL within 6 days
from the receipt of goods. HCL retains the right to reject such claims, which it
does not deem fit without assigning any reason. The claims received / made after
the above period will not be entertained by HCL. However all such claims shall be
subject to final acceptance by the insurance underwriter / insurance company engaged
by HCL.
5. HCL is not responsible for shipping or other delays caused by events beyond HCL's
reasonable control. 6.In the event of customer failing to take delivery of products
ordered by them, HCL may (in addition to its other legal remedies) recall or deal
with the products at its absolute discretion. In such a case, customer will be liable
to reimburse HCL actual bank charges, loss on disposal of products, if any, and
freight incurred in dispatching and recalling the products. HCL's claim on all such
charges shall be final and binding on the customer.
The exhibits in the website are mere invitation to offer and not an offer as such. Prices shown in the Website do not include sales tax or shipping and handling charges. Orders are not binding upon HCL until accepted by HCL.
Any quotations given by HCL will be valid for the period stated in the quotation.
An Order, if accepted by HCL, will be processed after receipt of valid demand draft for the full order value in the favour of HCL Infosystems Ltd, payable at Delhi .
HCL accepts payment through VISA, Master Card and may impose credit card surcharges. Terms of payment are within HCL's sole discretion, and, unless otherwise agreed to by HCL, payment must be received by HCL prior to HCL's acceptance of an order.
All credit card transaction shall be subject to receipt of authorization from our Bank for each transaction and confirmation of credit by the credit card issuing bank.
The customer and the receiver of the goods shall be jointly and severally liable for all risk and consequences associated with the credit card transaction.
The customer and the receiver of the goods shall jointly and severally indemnify HCL and hold HCL harmless from and against all actions, proceedings, claims, liabilities (including statutory liability), penalties, demands and costs (including without limitation, legal costs of HCL), awards, damages, losses and/or expenses however arising directly or indirectly as a result from: (i) use of the credit card (ii) any claim by HCL's Bank to refund the money collected against the credit card transaction provisionally authorized due to non confirmation of credit by the credit card issuing Bank for whatever reasons.
If you choose Cash-On-Delivery as your mode of payment, the goods ordered by you will be sent to the name and address which you have mentioned in the order.
